All purchases made in our online store www.SILCASTUDIO.com are subject to these general contracting conditions set out in this document. The sales held are distance sales regulated by current Spanish legislation on the matter.
1. Identification.
SILCASTUDIO.com is a business unit belonging to SILCA STUDIO, a company legally constituted in Spain with fiscal domicile in Malaga (Spain).
2. Activity.
SILCA STUDIO, is a company whose purpose is the distribution and sale of articles wholesale and retail, both locally and by Internet and by telephone, nationally and internationally.
3. Contents and information provided.
SILCA STUDIO establishes a series of processes carried out by our team of professionals together with our technology, to offer all the information contained on our website clearly and truthfully.
SILCA STUDIO reserves the right to modify the commercial offer presented on our website (modifications on products, prices, promotions and other commercial and service conditions) at any time.
In the event that at any time an error of any kind occurs, alien at all times to our will, it would be immediately corrected. If there is a typographical error in any of the prices shown or in the characteristics of the product, and a client has made a purchase decision based on said error, SILCA STUDIO will notify the client of said error and the client will have the right to cancel their purchase without no cost on your part.
The descriptions and images of the articles that appear on SILCASTUDIO.com are indicative of each product, as we indicated, the making and embroidery of them is done individually in our workshop. This individual process makes each garment unique with its own small nuances.
4. Prices and applicable taxes.
All the prices of our products do not include value added tax (VAT) and Recycling (WEEE) if applicable. For international sales that are made outside of Spain and for sales to the Canary Islands, Ceuta and Melilla, the costs of customs clearance and import taxes are not included in the price of the product or shipping, and must be paid at destination by the recipient of the merchandise if they exist. The prices of our products are set by default in Euros.
5. Sales system.
To make your purchase, you just have to select the product you want on our website and click on "Add to cart".
6. Payment method.
Payment for your order may be made by Card, PayPal or Bank transfer to the account number that will be indicated in your order.
7. Form, expenses and delivery time.
Shipping costs vary depending on the destination and are:
- Shipping to mainland Spain: €4.50 (taxes not included) and Free for orders over €200 (taxes not included).
- Shipping to the Balearic Islands: €9.50 (taxes not included) and Free for orders over €400 (taxes not included).
- Shipping to Ceuta, Melilla and the Canary Islands: €19.50 (taxes not included) and Free for orders over €600 (taxes not included).
- Shipping to Europe zone 1/2 (Germany, Austria, Belgium, France, Holland, Italy, Luxembourg, Monaco and Portugal): €25.00 (taxes not included) and Free for orders over €600 (taxes not included).
- Shipments to Europe zone 3/4 (Bulgaria, Denmark, Slovenia, Estonia, Finland, Greece, Hungary, Ireland, Latvia, Lithuania, Norway, Poland, United Kingdom, Czech Republic, Slovak Republic, Romania, Sweden and Switzerland): €50.00 ( Taxes not included) and Free for orders over €1,200 (taxes not included).
For the rest of the destinations the freight is € 190 (taxes not included) although you can contact us and request to send us your transport agency to collect the order once it is ready. This option is only available for destinations not mentioned above, with payment by bank transfer and upon request.
To calculate the delivery times you have to take into account that, once we receive your order, it is made especially for you, so the delivery times are:
- Shipping to mainland Spain: 4 to 5 days (business days)
- Shipping to the Balearic Islands, the Canary Islands, Ceuta and Melilla: From 7 to 9 days (working days)
- Shipping to the rest of Europe: 7 to 9 days (business days)
- Shipping to the rest of the World: From 15 to 20 days (working days)
Transport times may be altered by extraordinary incidents in the carrier and by difficulties in the delivery of goods (for example, storms or strikes). In case of delivery problems, a contact phone number will be entered in your account that you must provide us.
The merchandise travels fully insured and you must report any problems such as breakages, in order to claim the replacement of the material within a maximum period of 24 hours after receiving it. After these 24 hours, the companies no longer take care of the damaged material, so SILCA STUDIO will seek the least harmful solution for both parties.
8. Policy of returns, cancellations and changes of products.
Our return policy is to grant you the right to return any of our products within a maximum period of 15 days from the date of receipt, provided that you keep its original seal or packaging and it has not been opened or used.
Three types of returns can be given:
A. That the product has arrived defective or is not the one you had requested and 24 hours have not passed since receipt of the order. In this case you must let us know by sending us an email to info@silcastudio.com and we will proceed to change it immediately and at no cost.
B. That the order has not yet been sent and you wish to cancel the order, in this case you will be reimbursed the full amount of your order at no cost.
C. That the order has already been shipped and 15 days have not elapsed since the receipt of the order. In this case, you must send us the order with your transport agency and we will have to wait for it to arrive at our facilities to proceed with the reimbursement of your order less the costs of our shipment.
9. Customer obligations.
The SILCASTUDIO.com client agrees at all times to provide truthful information about the data requested in the registration forms that identify the buyer and the shipping and billing addresses, as well as to keep them updated at all times.
SILCASTUDIO.com gives the consideration of customer or consumer to those who enter their data correctly, truthfully or in good faith, so the recording of false data, in addition to carrying the consequences provided by law (Penal Code, articles 248 , 255, 387, 392, 395, 623), implies for the client the loss of the status of consumer and of the benefits provided for the consumers.
The client agrees to accept all the provisions and conditions contained in these General Conditions of Purchase, understanding that they include the best possible service willingness for the type of activity we carry out. Likewise, you agree to keep your personal access codes to our website confidential and with the utmost diligence.
The client agrees to enable the delivery of the requested order by providing a delivery address where it can be received within the normal delivery time of goods (Monday to Friday from 9:00 a.m. to 1:30 p.m. and from 4:00 p.m. to 6:00 p.m. : 00). If the office is better than the home address, please provide the second address.
In case of breach by the customer of this obligation SILCA STUDIO will have no responsibility for the delay or impossibility of delivering the order requested by the customer. Keep in mind that you can give the address that best suits you depending on your circumstances.
10. Data Protection Law.
SILCA STUDIO guarantees the protection and confidentiality of personal, domiciliary, payment and any other data provided by our clients.
All the data provided by our clients to SILCA STUDIO or its employees will be included in an automated personal data file created and maintained under our responsibility.
For technical reasons, for the correct fulfillment of the purchase order made, your data must be made available to SILCA STUDIO. In the event that the data provided is associated with a purchase, Spanish legislation requires us to keep it for at least five years, so it cannot be deleted or rectified even if the client requests it.
SILCA STUDIO requests your authorization to process your data in the manner and for the purposes just indicated. If you do not want this treatment to take place and you have not made any purchase, please send us an email message to info@silcastudio.com, writing in the Subject: Cancel and your data will be destroyed.
However, and in accordance with the provisions of the Data Protection Law, Organic Law 15/99 of December 13, the client of SILCA STUDIO may at any time exercise the rights of access, rectification, cancellation and, where appropriate, revocation of the consent in the aforementioned Law and other regulations that develop it, writing to our email address info@silcastudio.com, writing in the Subject: Cancellation.
The content of this page may change in accordance with the requirements of the legislation in force at any time, so you should review it regularly.
11. Confidentiality Policy.
SILCA STUDIO guarantees the confidentiality of the data.
At SILCA STUDIO we value the trust you have placed in us. Therefore, ensuring the confidentiality of your data is our maximum commitment. The ideas, suggestions or any other information that you decide to share with us, will be used exclusively to provide you with a better service.
12. Applicable legislation and competent jurisdiction.
The purchases made at SILCA STUDIO are subject to Spanish legislation.
In the event of any conflict or discrepancy, the applicable jurisdiction will be that of the Courts or Tribunals of Malaga (Spain).
13. Guarantees.
SILCA STUDIO will request the client the invoice to exercise the guarantee of all the products that could be defective. This will be essential. The delivery of the material will be the responsibility of the client, and the replacement and shipment (after verification), free through the means that SILCA STUDIO considers most appropriate, within an approximate period of 15 days.
SILCA STUDIO makes every effort to offer the information contained on the website truthfully and without errors.
At the moment that a client registers, all their data is incorporated into our database, being used only to process the order, as well as to send information about offers and services that may be of interest to them.
In compliance with the provisions of Organic Law 15/1999 of December 13, and subsequent ones that are developed, SILCA STUDIO clients can, at any time, exercise their rights of access, rectification, cancellation and opposition on their personal data communicating it in writing. SILCA STUDIO is subject at all times to Spanish legislation.
